YORG LLC (“YORG,” “we,” or “us”) is a swim analysis service provider operating in Virginia and New York. We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, and share personal information when you use our website and related services (including contact forms, scheduling tools, and newsletter sign-ups). It also describes your rights regarding your personal data. We have written this policy in plain English to be clear and transparent. By using our website or services (or by clicking any consent boxes or banners on our site), you agree to the practices described in this Privacy Policy.

Information We Collect

We collect personal information in several ways, including information you provide directly and information collected automatically. Here are the types of data we handle:

  • Media and Performance Data: If you become a client, we may collect additional data necessary to perform the swim analysis. This can include video recordings of your (or your child’s) swimming sessions, photographs, timing or performance metrics, and biometric data from swim wearables or devices (e.g., stroke rate, heart rate) if those are used in the analysis. This information is usually obtained during in-person sessions or through materials you provide to us, and is used solely for providing you with feedback and results.

  • Information Collected Automatically: Like most websites, our site automatically collects some information about your visit via cookies and other tracking technologies (see Cookies and Tracking Technologies below for details). This may include:

  • Technical Data: Your IP address, browser type, device type (e.g., mobile or desktop), operating system, and unique device identifiers.

  • Usage Data: Details about how you navigate and use our site, such as the pages or content you view, the dates/times of your visits, what links you click, and how you arrived at our site (e.g., via a search engine or referring link).

  • Cookies and Tracking IDs: Cookies or similar technologies may assign an ID to your browser to remember your preferences or track your usage of our site over time. We do not collect sensitive personal information like Social Security numbers or financial account numbers through our website. We also do not intentionally collect any health or medical information online (aside from any you choose to share about a swimmer’s condition relevant to training, which we advise only providing with consent). Any payment for services is handled through separate invoicing or secure third-party payment processors, not via forms on our website.

Note: If you choose not to provide certain personal information (for example, opting not to fill in a required field on a contact or scheduling form), we may not be able to fulfill your request or provide the related service (such as scheduling a session or sending you our newsletter).

How We Use Your Information

YORG uses the personal information we collect for the following purposes:

  • To Provide and Improve Services: We use your information to carry out the services you request. For example, if you schedule a swim analysis, we will use your contact details to confirm your appointment and possibly gather more details about your swimming for a successful session. If you are a client, we use the data (including any video or performance metrics) to analyze your swimming technique and provide tailored feedback and results. We may also use information and feedback from clients to improve our swim analysis techniques, services, and website (in an aggregated or de-identified way when possible).

  • To Communicate with You: We use contact information (like email or phone) to respond to inquiries you send us through our contact form or email. If you schedule a session or sign up for services, we will send you communications related to those services (such as confirmations, reminders, results delivery, or follow-up support). We may also communicate with you about changes to our services, terms, or this Privacy Policy.

  • Newsletter and Marketing (with Consent): If you expressly sign up for our newsletter or mailing list, we will use your email address to send you our newsletter, updates about YORG LLC, swim tips, or promotional offers. You can opt out of these communications at any time (see Your Rights and Choices below). We will not send you marketing emails unless you have opted in, and you can unsubscribe easily if you change your mind.

  • Website Analytics and Personalization: We use data about how visitors use our website to understand what content is most useful, to fix technical issues, and to improve the user experience. Currently, our site does not respond to DNT signals in any special way, because there is no consistent industry standard for compliance. We treat all visitors in line with the practices described here, regardless of DNT. You can still manage tracking by adjusting cookie settings as described above.

How We Share Your Information

We understand the importance of keeping your personal information private. We do not sell or rent your personal information to third parties. We only share your information in the following limited situations, and always with safeguards for your privacy:

  • Service Providers: We may share your information with trusted third-party companies that perform services on our behalf, in order to run our business and provide our services to you. For example, we use service providers for website hosting, data storage, email delivery, scheduling and appointment management, and video storage/analysis. These providers only receive the information necessary to perform their specific services. They are contractually obligated to protect your data and use it only for our purposes, following our instructions. Examples include our scheduling tool (which will handle your name and contact info to book sessions), our email/newsletter platform (which stores your email address for sending newsletters if you subscribed), and our video analysis or cloud storage platform (which might host your swim videos or analysis results for you to access securely). Each of these providers has its own privacy and security commitments, and we select providers carefully to ensure they meet high standards of data protection.

  • Analytics and Tracking: As noted, we use Google Analytics and similar tools to collect usage information. These tools may process your data (like IP address and device info) for us. Google may also use this information for its own analytics purposes. However, we do not share any directly identifying personal info (like your name or contact) with Google Analytics. We have controls in place so that these analytics providers cannot use the data we share for any purposes other than providing services to us (for example, Google’s terms forbid them from using Google Analytics data for their own advertising or other users’ purposes). Nonetheless, to fully understand how such third parties handle data, please refer to Google’s own privacy policy.

  • Business Partners or Collaborators (with Consent): If in the future we partner with another company for a joint offering or event (for example, a co-hosted swim clinic), and you sign up for that, we might share your registration information with that partner but only with your knowledge. For instance, if you register through our site for an event co-sponsored by another organization, we’ll let you know in the sign-up form if your information will be shared with them. They would then be expected to protect your data similarly. (This is a hypothetical scenario to illustrate; we will always be transparent about such sharing if it arises.)

  • Legal Compliance and Protection: We may disclose personal information if we believe in good faith that such disclosure is necessary to comply with a legal obligation or request (such as a law, regulation, warrant, subpoena, or court order). We may also share information if needed to enforce our agreements or policies, to collect outstanding fees, to protect our rights or property, or to ensure the safety of our clients or others. For example, if required by law enforcement as part of an investigation, or if sharing data with authorities could prevent harm in an emergency, we will do so as permitted by law. We will strive to notify you of any such disclosure when allowed, unless we are legally prevented from doing so.

  • Business Transfers: If YORG LLC ever undergoes a business transition such as a merger, acquisition by another company, or sale of all or part of its assets, personal information we have collected may be among the assets transferred to the new owner. Should this happen, we will require that your data remains protected by a Privacy Policy with terms equivalent to those in place now, and we will notify you (for example, via a notice on our website or email) of any such change in ownership or control of your personal information, explaining your options at that time.

  • With Your Consent or At Your Direction: Aside from the cases above, we will only share your personal information with third parties if you have specifically asked us to or given us permission. For instance, if you ask us to coordinate with your swim coach or another third party in delivering your analysis results, we will share information as needed at your request. Or, if we ever wanted to feature your success story or footage on our website or social media, we would only do so with your explicit consent (as also outlined in our Media Release form). In short, you are in control of whether we disclose your personal info in any optional scenario.

Third-Party Links: Our website may contain links to other websites or services that we do not operate (for example, links to a swim equipment provider, or our social media pages). If you click those links, you will be directed to third-party sites which have their own privacy policies and practices. We are not responsible for the content or privacy practices of sites we do not control. We recommend you review the privacy policy of any third-party site you visit. This Privacy Policy applies only to YORG LLC’s website and services.

Data Storage and Security

We take the security of your personal information seriously. YORG LLC stores personal data primarily in electronic form on secure servers. These servers may be cloud-based (with reputable providers) and are typically located in the United States. We employ a variety of security measures to protect your information from unauthorized access, disclosure, alteration, or destruction, including:

  • Access Controls: Personal data is accessible only to those people at YORG who need it to perform their job duties (for example, our coaches/analysts who prepare your swim analysis, or staff handling customer inquiries). Access to sensitive data (like your videos or contact details) is protected through account authentication and permissions.

  • Encryption: We use encryption and secure protocols where appropriate. For instance, our website is protected via HTTPS, which encrypts data transmission between your browser and our site (you’ll see the padlock in your browser address bar on our site). If we store or transfer particularly sensitive data (such as video files or analytics reports), we endeavor to encrypt those files or use secure services that do so.

  • Firewalls and Monitoring: Our systems are protected by network security measures like firewalls. We also maintain up-to-date software and monitor our systems for possible vulnerabilities or attacks. We keep our website platform, plugins, and software tools updated to patch security risks.

  • Training and Policies: We train our staff about the importance of privacy and security. We have internal policies in place to ensure that personal data is handled and disposed of safely. For example, if we download a video of your swimming for analysis, we ensure it’s stored in a secure folder and is deleted when no longer needed (unless you’ve given permission for longer retention or reuse).

Despite our best efforts, no method of transmitting data over the internet or storing data electronically is 100% secure. Therefore, while we strive to protect your personal data, we cannot guarantee absolute security. You can help protect your data by using strong passwords, keeping your own devices secure, and not sharing your account credentials with others (if you have an account or portal with us).

Data Breach Procedures: In the unlikely event of a data breach or security incident that compromises your personal information, we will act promptly to contain and investigate the issue. We will also notify affected individuals and the relevant authorities as required by law. For example, Virginia and New York laws (and other applicable laws) may require us to send notifications if certain categories of personal data are exposed. You can be assured we will be transparent and communicate with you as needed to protect your rights in such an event.

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, or as required by law or legitimate business needs. How long we keep data depends on the type of information and the context in which it’s provided:

  • General Inquiries and Contact Info: If you contact us with a question but do not end up using our services, we may retain the correspondence (and your contact details) for a period in case we need to reference it or reach back out. Typically, we wouldn’t keep casual inquiry data for more than a year or two, unless you become a client or you ask to remain on a mailing list.

  • Client Data (Service Records): If you engage our swim analysis services, we will retain the data related to that service (like your contact info, notes from your sessions, and analysis results) as long as needed to provide the service and for a reasonable period thereafter. By default, we keep client records for a certain time in case you return for follow-up sessions or to track progress. Video footage and raw performance data from your sessions will be stored for delivering your analysis and for a short period afterward for any needed review. We understand that such data can be sensitive, so we will not keep it longer than necessary. You have the right to request deletion of your footage and data (see Your Rights and Choices below), and we will honor such requests in a timely manner. Otherwise, we might retain analysis videos for a period (e.g., up to a year) in secure archives in case you need them resent, unless you instruct us to delete them sooner.

  • Newsletter Subscription: If you have signed up for our newsletter or marketing emails, we will retain your email on our mailing list until you unsubscribe or ask us to remove it. If we receive multiple bounces or inactivity, we may remove your address as part of list maintenance.

  • Legal and Accounting Records: In some cases, we need to keep certain information for longer to comply with legal obligations or for legitimate business records. For instance, we may retain transaction records, invoices, or signed agreements (which include names and contact info) for a number of years as required by tax laws or to have an accurate financial and legal record of our business activities. Similarly, if you have signed any waivers or consent forms, we may keep those on file as long as needed to enforce the terms or to defend against any legal claims, within applicable statutes of limitations.

When we no longer have a need to retain your personal information, we will securely delete or anonymize it. For example, personal data in digital form will be deleted from our active systems and any backups will eventually be purged or overwritten in the normal backup cycle. Physical documents (if any) will be shredded or securely disposed. If complete deletion is not immediately feasible (for example, stored in long-term backups), we will ensure the data remains protected and isolated until deletion is possible.

Your Rights and Choices

You have certain rights and choices when it comes to your personal information. We believe it’s important you can control your data. Depending on your location (for example, Virginia residents have specific rights under the Virginia Consumer Data Protection Act), and generally as part of our commitment to privacy, your rights include:

  • Access and Transparency: You have the right to know what personal information we have about you. You can request a copy of the data you have provided to us or that we maintain about you. We will provide you with a summary of this information in a readable format, typically within a reasonable time. For example, you can ask, “What information do you have about me?” and we will verify your identity and then share the details we have (contact info, communications, any service records, etc.). This helps you stay informed about how your data is being used.

  • Correction and Updates: If any of your personal information is inaccurate or has changed (for instance, you change your email address or notice we recorded something incorrectly), you have the right to request that we correct or update it. We encourage you to keep your information up to date by contacting us with the new details. We will promptly make the corrections upon verification.

  • Deletion (Right to Be Forgotten): You can request that we delete your personal data. For example, if you no longer want us to have your contact information on file, or you want us to delete videos or analysis data after your service is completed, you can ask us to do so. We will erase the requested information from our active systems and cease to use it. Keep in mind there may be certain information we must retain for legal or internal business reasons (as noted in Data Retention above) — for example, we might need to keep a record that you received a service for accounting purposes, or retain a signed waiver form. But we will explain if any data cannot be completely deleted and ensure any retained information is minimized and used only for those necessary purposes. We will confirm with you once we have deleted the requested data.

  • Opt-Out of Marketing Communications: If you are receiving our newsletter or promotional emails, you have the right to opt out at any time. You can click the “unsubscribe” link at the bottom of any marketing email we send, or you can contact us directly asking to be removed from our mailing list. Once you opt out, we will stop sending you non-essential communications. (Please note, even if you opt out of marketing messages, we may still send you transactional or service-related messages when necessary, such as a session confirmation or an important notice about your account, since those are not promotional.)

  • Opt-Out of Analytics/Tracking: As mentioned in Cookies and Tracking, you have options to disable or limit cookies and tracking. You can use our cookie consent tools or your browser settings to block analytics cookies if you do not want your site activity to be tracked. You can also install the Google Analytics opt-out extension. While we don’t use personal data for targeted advertising, if we ever do use cookies or data for advertising purposes, we will provide a clear way for you to opt out of that as well (for instance, via a “Do Not Sell or Share My Personal Information” link or a setting in the cookie banner, if applicable). Currently, we do not sell data or share it for cross-context behavioral advertising, so this is not an issue you need to worry about with YORG LLC.

  • Withdraw Consent: In cases where we are processing your personal information based on your consent (for example, if you consented to our use of certain cookies or if you gave consent for us to use a testimonial or media of you), you have the right to withdraw that consent at any time. Withdrawing consent will not affect the legality of any processing we did prior to your withdrawal, but it means we will stop the specific use going forward. For example, if you consented to our use of your video for marketing and later change your mind, you can withdraw consent and we will cease any new use of that video in marketing materials. (Do note that if something has already been published with your permission, we might not be able to undo what’s already public, but we will honor your wishes for future use.)

  • Non-Discrimination: Exercising your privacy rights will not result in any discrimination or lesser service from us. We value all users’ privacy choices. If you opt out of certain uses of your data, we will still strive to provide you with excellent service. However, understand that some services may be limited if you do not allow us to use certain information (for instance, we cannot schedule a session without contact information, and we cannot provide a swim analysis without collecting footage or performance data). We will explain any such impacts if relevant when you make a request.

How to Exercise Your Rights: If you wish to exercise any of the rights above, please contact us (see Contact Us below). We may need to verify your identity to process certain requests (especially for access, correction, or deletion of data) – this is to protect your privacy and ensure we don’t give your data to an unauthorized person. Verification might involve confirming some information we already have on file or asking for identification in a secure manner. We will respond to your request as soon as we can, generally within 30 days. If for some reason we need more time (for example, if the request is complex or we need clarification), we will let you know and keep you updated on the progress.

Please note that if you are a resident of certain jurisdictions (such as Virginia), you may have specific avenues to appeal a decision we make regarding a privacy request. We will provide instructions for appeal if we cannot honor your request for some reason. That said, our goal is to fulfill reasonable requests whenever possible and applicable.

Children’s Privacy

Protecting children’s privacy is especially important to us. Our website and services are not directed to children under 13 years of age, and we do not knowingly collect personal information online from children under 13 without verifiable parental consent.

  • No Collection from Young Children: If you are under 13, please do not submit any personal information to us (including your name, contact details, or any messages). If we discover that we have inadvertently collected personal data from a child under 13 through our website (for example, if a child submits a contact form with their information), we will delete that information as soon as possible.

  • Parental Involvement: We encourage parents and guardians to be aware of and involved in their children’s online activities. We will take prompt action to investigate and remove the information.

  • For Minors Over 13: Our online contact forms and newsletter sign-ups are intended for adults (or minors aged 13+ with appropriate consent and supervision). If you are between 13 and 18 years old, you should only use our site and services with the involvement of a parent or guardian. When providing information for swim analysis services that involve minors, we always require parental or guardian consent as part of the sign-up process offline (for example, a parent must sign our consent forms for any participant under 18). Personal information about minors (such as videos of a swimmer who is a minor, or their performance data) is handled with extra care and is only collected with explicit parent/guardian permission. We do not use a minor’s personal information for any purpose beyond providing the agreed services, and we do not share a minor’s identity or image publicly without the appropriate consent (as detailed in our Media Release and Consent procedures).

  • COPPA Compliance: We adhere to the U.S. Children’s Online Privacy Protection Act (COPPA) and any relevant state laws regarding minors’ privacy. This means we will never knowingly collect, use, or disclose personal information from children under 13 except as permitted by law (for example, with parental consent, or to respond directly to a child’s one-time request, etc., in accordance with COPPA guidelines). Any information inadvertently collected from a child will be deleted upon discovery, as stated above. Parents have the right to review any personal information we may have collected about their child, request its deletion, and refuse to allow any further collection or use of the child’s information. Updates to This Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will revise the “Effective Date” at the top of this policy.
